No. Unless you exclude yourself, you give up any right to sue Defendants and the other entities released in the Settlement Agreement for the claims that this Settlement resolves. If you have a pending lawsuit involving the same claims that this Settlement resolves, speak to your lawyer in that case immediately. You must exclude yourself from this Class to continue your own lawsuit. If you have a pending lawsuit on matters not addressed in this Settlement, you may continue that lawsuit against Defendants.
No. Class Counsel will answer questions that the Court may have. But, you are welcome to come at your own expense. If you send an objection, you don’t have to come to Court to talk about it. As long as you mailed your written objection on time, the Court will consider it. You may also pay your own lawyer to attend, but it’s not necessary.
You may ask the Court for permission to speak at the Fairness Hearing. To do so, you must send a letter saying that it is your “Notice of Intention to Appear” in Stephen J. Tuttle, et al., v. Audiophile Music Direct, Inc., et al., Case No. 22-cv-01081. Be sure to include your name, address, telephone number, and signature. Your Notice of Intention to Appear must be postmarked no later than October 6, 2023 and sent to the Clerk of the Court and the Class Counsel, at the addresses below:

A new account will be created for you based off your first name, last name, and email address that was provided on your Qualifying Settlement Claim Certification Form. To access this account, you will need to request a password reset to login.
If you DO have an existing account with Music Direct associated with the email you provided on your Qualifying Settlement Claim Certification Form:
Login to your account on www.musicdirect.com as you normally would. You will only be able to view your account Coupon credit during the checkout process. When you first begin the checkout process, you will see there is an account credit in the “Summary” section on the upper right part of the webpage. The credit will automatically calculate into the totals without any user interaction required. As you progress through the checkout steps, there will be a checkbox which will be checked by default. Please note that that you CAN uncheck the checkbox if you do not wish to apply that credit to your order.
Redeeming your Coupon credits and making additional payments, if any, that may be required on purchases:
Payment information in addition to your Coupon credit would only be required if a purchase balance due remains after applying the amount of your Coupon credit. Once you submit your Coupon credit and any necessary payment information (for any purchase amounts exceeding your Coupon credit amount) and the purchase order is confirmed, you will be charged only for the excess amount of your purchase. If you have any Coupon credit remaining after a purchase, it can be used on future purchases.

Music Direct will be sending you a prepaid shipping label to return your Applicable Records in Mid-April. Once you have received your label, you will have 90 days to return your Applicable Records. Refunds will be sent out at the end of the 90 Day Return period.
